What legal rights do grandparents have?

Under the current law, grandparents do not have an automatic right to access their grandchildren. However, the courts recognise and encourage that a child maintains some form of contact with family members, especially if the child had a close relationship with his or her grandparents prior to separation.

In all cases of family law involving children, the Courts will always judge the interests of the child to be of the highest importance.

Will we have to go to Court to get access to our grandchildren?

It is not always necessary to go to court when trying to reinstate contact with your grandchildren. It is encouraged to attempt contact via negotiations with the resident parent who has custody of the child or children.

Matters can be progressed further via Family Mediation, although all parties must consent to this and be willing to co-operate with each other. Should mediation fail, grandparents may apply to the courts to seek contact with their grandchild or grandchildren.

If the courts believe that reinstating contact with you will benefit the children, then you will be granted what is called a 'Living Arrangements Order'. This order will set out how and when the contact will take place and for how long.

A Court Order must be followed by all parties involved. Parents cannot revoke contact without good reason and without going back to court to seek permission for the same.
