If you are being abused by your partner, whether that is emotionally, psychologically, or physically, you may apply for an Injunction. An injunction is a court order that sets out what a person can and cannot do.
Usually, in family law, people typically want injunctions against a husband, wife, or partner, however, it is also possible to apply for an order against anyone in your family, or with whom you have had a close relationship, who has sought to abuse you. You can also seek protection for your child.
If you are in immediate danger and cannot afford to wait any longer, you can apply for an emergency injunction. This is known as an ex-parte order which places restrictions effective immediately. Notice of such an application is not given to the other person and they only become aware of it once they have been served with the documents.
There are two basic types of injunctions the court can make under the Family Law Act 1996:To find out more about the different types of domestic abuse injunctions, click on a service above.
