Making an application

To apply for the emergency measure of an injunction, you need to complete the form for permission for a judicial review, unless a Judicial Review has already been lodged. Please see our Judicial Review page for more information.

You need to explain why the application is urgent, and how quickly you require the application to be considered. This is likely to be before the end of your removal notice period.

Can I be removed while making a Judicial Review application?

Applying for Judicial Review is not enough to prevent deportation. In most cases, if permission to proceed with a Judicial Review is granted, the Home Office will only defer removal, rather than cancel it.

However, the Home Office will not defer removal any of the following conditions are met:

• There has been less than 6 months since a previous Judicial Review or Appeal has concluded on similar issues.
• There has been less than 6 months since a previous Judicial Review or Appeal has concluded and the issues raised could have been raised previously.
• The Judicial Review proceedings are brought during the three-month removal window.
• You are due to removed on a charter flight and bring Judicial Review Proceedings against removal.
