Jewish Divorce

Separating from your spouse can be a daunting experience, pursuing a religious divorce can complicate matters further. It is important to consult specialist divorce lawyers who can help you reach an amicable settlement in accordance with the Jewish faith.

Jewish Divorce

It is vital that you complete a Jewish divorce along with your civil divorce to ensure that matters are dealt with together and not left to cause issues in the long term, especially if you have children or wish to remarry.

Jewish divorce according to Halacha

According to Halacha, a couple can only be released from the bonds of matrimony when a bill of divorce is passed from the husband to the wife. This document is normally referred to in its Aramaic name; a 'Get'. This acts as proof of the marriage's dissolution.

Process of obtaining a Jewish divorce

It is important to understand that a Jewish divorce must run alongside a civil divorce as a Get is usually not passed to the couple by the Beth Din until the civil Decree Absolute has been issued.

The process of obtaining a Jewish divorce is dependent upon the branch of Judaism an individual is a member of. However, a general process is as follows:

Child arrangements following divorce

We understand that there may be concerns about your children following your divorce. These may include:
  • If your former partner has different religious views, or changes to a more Orthodox or liberal branch of Judaism.
  • How and where your child is educated, whether a secular or religious school and which one. This can include whether, and where your child attends Sunday school (Cheder).
  • Who your child spends Shabbat weekends with.
  • Who your child spends key Jewish festival days with (particularly the High Holy Days of Rosh Hashannah and Yom Kippur). Aside from these High Festivals, you might wish your children to be with you during festivals where children are particularly involved, such as Simchat Torah or Purim.
  • Disputes about the degree of observance of Jewish dietary laws.
